How peptide legality works in the US

Peptide regulation in the US has three primary layers:

  1. FDA approval — fully approved peptides like semaglutide and tirzepatide can be prescribed in every state.
  2. FDA bulk-substance categories — Category 1 (compounding allowed under 503A), Category 2 (under review), Category 3 (compounding restricted). Categories are set federally and apply nationwide.
  3. State pharmacy boards — each state licenses compounding pharmacies, sets sterile-compounding inspection rules, and enforces non-resident pharmacy registration. Some states (Massachusetts, New York, California, Texas, Florida) add stricter inspection and reporting on top of federal rules.
